What is this privacy statement about?

With this privacy policy we inform you about the processing of your personal data in connection with your application via our online applicant platform.
This online applicant platform is operated jointly by the companies of the GOPA Consulting Group. The GOPA Consulting Group consists of the following companies, all of which are based within the European Union.

We attach great importance on the protection of your personal data and treat your privacy in compliance with the General Data Protection Regulation (GDPR, Regulation EU 2016/679) of the European Union (EU) and the applicable national legislation on personal data protection (e.g., in Germany, the Federal Law for Data Protection, BDSG n.F.)
Your application via this online applicant platform is not possible without providing personal data. We process your personal data only in accordance with the information set out in this Privacy Policy. If further 
processing should become necessary at a later stage, we will obtain your consent separately again.

Which terminology is used in this privacy policy?

Our activities for the processing of personal data are subject to the General Data Protection Regulation (Regulation (EU) 2016/679).
'Personal data' is any information that can be used to identify you, including your name, email address, IP address, or any other data that could reveal your physical, physiological, generic, mental, economic, cultural or social identity.
For the purpose of the GDPRs, we are the 'data controller' of all personal data obtained by us as set out in this policy, because we ultimately determine how your personal data will be handled by us or our sub-contractors, who would be our 'data processors'.
If we handle your personal data, then you are a 'data subject'. This means you have certain rights under the GDPR in relation to how your personal data is processed, which are set out in this privacy policy.

Who is responsible for the processing of personal data?

The responsible controller of your personal data is the company of the GOPA Consulting Group to which you are submitting your job application. Which personal data do we store and process?

We store and process the personal data that we receive from you as part of the application process. This data comes either from the application form you filled in online on the applicant platform or from the files you uploaded (cover letter, passport photo, curriculum vitae, certificates, etc.). 
In addition, technical usage data is processed when using the applicant platform. You will find more information on this in the section 'Which data is processed purely for technical reasons?' of this privacy policy (see below).

For which purposes do we process your data and what is the legal basis for the processing?

We process your data for the following purposes and on the basis of the legal bases stated here:
  • Application and if necessary, contract initiation with you including communication with you with the legal basis Art. 6 para. 1 lit. b GDPR.
  • Efficient and better coordination of the application process, including the processing of declarations of consent and revocation and, where appropriate, the handling of pre-contractual claims. The legal basis for this processing of your personal data is Art. 6 para. 1 lit. f GDPR.
  • Effective guarantee of your data protection claims pursuant to Art. 6 para. 1 lit. c GDPR.
  • Improve the usability of this website and ensure a stable and secure operation of the website with reference to Art. 6 para. 1 lit. f GDPR as legal basis.
We process your personal data in accordance with the provisions of the European Data Protection Basic Regulation (GDPR) and the Federal Data Protection Act (BDSG n.F.).

Where do we transmit your data to

If we cannot offer you a position in the company of the GOPA Consulting Group to which you have submitted your job application, we may place your application in the Group's internal pool of applicants, which will make your application known also to the other companies of the Group. However, we do this only if you have agreed to this procedure by ticking the option 'I agree to the storing of my job application in the GOPA Consulting Group's pool of applicants' in the online application form (opt-in). The sole purpose of placing your application in the Group's pool of applicants is to find a potentially vacant position for you in another company of the Group and then to continue the application process with that company.
The companies of the GOPA Consulting Group are all located within the EU. A transfer to other recipients within or outside the EU does not take place. If we store your application in the Group's pool of applicants, only the heads of the departments potentially suitable for future employment as well as the responsible personnel department have access to your application data. If your application will be considered for a particular position, some members of the respective team may also have access to your application.
For the technical transfer of your data to our personnel department, we use the service provider job.net Service, located in Germany, as data processor. However, the data processor will not process your data for his own purposes, but exclusively on our behalf in accordance with the information provided by this privacy statement.

What are your rights in terms of personal data protection?

You have the following rights in relation to your personal data:
  • Right to confirmation - you can ask us to confirm whether we are processing personal data concerning you.    
  • The right to be informed - this is information on the personal data we are processing and the purpose for which we are processing them.    
  • The right of access - you have the right to be provided with copies of your personal data that we are processing.    
  • The right to rectification - if you think the personal data that we hold on to you is inaccurate or incomplete you can request us to correct this.    
  • The right to erasure - if you want us to delete the personal data, we are holding for you then you can request us to do so.    
  • The right to restrict processing - if you oppose the way how we are processing your personal data then you have the right to inform us accordingly and we will restrict the processing on the basis of your right.
  • The right to data portability - if you want us to forward your personal data to a different organisation or person then you have the right to inform us, and we will transfer your personal data respectively (without adversely affecting the rights of others).    
  • The right to withdraw your consent - you can withdraw your previously given consent to the processing of your personal data at any time by contacting us using the contact form provided.
If you wish to exercise one or more of these rights, please contact our staff who was in contact with you during the application process or one of the contact addresses provided in this Privacy Policy. You can request your rights free of charge unless your request is obviously unfounded, repetitive or excessive. In these circumstances, we may refuse to comply with your request. In accordance with the GDPR, we will try to respond to all legitimate requests within one month.
In addition to the above rights, as a data subject you have the right to lodge a complaint with your local data protection authority within the European Union. Please note that you can use whichever local data protection authority within the EEA that is most convenient for you.

Which automated decision making takes place and which profiles are generated from your data?

Our decision making during the application process is in no case based on automated processing of your data as per Article 22 DSGVO. Furthermore, your personal data will not be used for any profiling purposes.

Which data is processed purely for technical reasons?

Beyond the application documents you are sending us, we collect and process data only for technical reasons with the purpose to improve the usability of this website.

Cookies

We are using cookies to help us make your use of the website better. Cookies are small text files placed on your computer by websites that you visit. They are widely used in order to make websites work or work more efficiently. We are using functional cookies to support your Internet browser in generating our web pages, which is essential to the running of the website but does not contain any personal data.
You may, at any time, prevent the setting of cookies by our website by means of a corresponding setting in your Internet browser and, thus, permanently deny the setting of cookies. Furthermore, you can delete cookies already set at any time via an Internet browser or other software programs. If you deactivate the setting of cookies in your Internet browser not all functions of our website may be entirely usable.

Usage data

We will store the IP address, the website accessed, and the date and time of access of all user's website visitors, including those who do not complete the application process.

How long do we store your data?

We delete your personal data in accordance with the requirements of the GDPR. 
This means that we delete your personal data as soon as they are no longer required for the fulfilment of the respective purpose (see above). Your data will no longer be required if you take up your position with us, if you withdraw your job application, or if your application has not been successful.
The data provided by you (texts and documents) are temporarily stored for processing in selected data centres, all of which are located in Germany. After the data has been retrieved by our HR department, all data from the data centres is permanently and irrevocably deleted and stored on the internal servers of the HR department.
We store your personal data on the servers of our personnel department for a maximum of 6 months or less if you should decide to object to their further storage. If we wish to store your data for longer than 6 months, for example in order to be able to consider you again in later job vacancies, we will obtain your consent separately again. If you have agreed to be included in the pool of applicants of the GOPA Consulting Group by ticking the respective option in the online application form, we will store your personal data in this pool for a maximum of 2 years.
The session cookies stored during the use of the online applicant platform are deleted after your browser session has ended. The IP addresses registered on our server are deleted after one month.

What happens if you do not agree to the processing of your data?

It is voluntary for you to give your consent to the processing of your personal data in accordance with this privacy policy. However, if you do not give your consent to the processing, we will not be able to process your application and will not be able to offer you a job.

What happens if this privacy policy changes?

If necessary, changes to this data protection declaration will be published on our applicant platform. In the event of substantial changes, we may also send you an email, and if required to do so by law, we will seek your consent to the changes.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

Use of cookies

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website. As a general rule, cookies serve the purpose of ensuring secure access to a website (“absolutely necessary”), implementing certain functionalities such as standard-language settings (“functional”), improving the user experience or the performance of the website (“performance”), or placing targeted advertisements (“marketing”). On this recruitment website, we generally use only cookies that are absolutely necessary, functional or performance-related, in particular for implementing certain default settings such as language, for identifying the job advertising channel, or for analyzing the performance of a job advert via which a user accessed this recruitment website. The use of cookies is absolutely necessary for providing our services and thus for the performance of the contract (article 6 (1) b) of the GDPR). Rights of data subjects

If Personio SE & Co. KG as the controller processes personal data, you as the data subject have certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), depending on the legal basis and the purpose of the processing, in particular the right of access (article 15 of the GDPR) and the rights to rectification (article 16 of the GDPR), erasure (article 17 of the GDPR), restriction of processing (article 18 of the GDPR), and data portability (article 20 of the GDPR), as well as the right to object (article 21 of the GDPR). If the personal data is processed with your consent, you have the right to withdraw this consent under article 7 III of the GDPR. To assert your rights as a data subject in relation to the data processed for the purpose of operating this recruitment website, please refer to Personio SE & Co. Concluding provisions

Personio reserves the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the services offered, for example when new services are introduced. In this case, the new data privacy statement applies to any later visit of this recruitment website or any later job application.
